Terms of Service

Welcome to Someday! These Terms of Service ("Terms") govern your access to and use of the Someday service, including our website and related services (collectively, the "Service"), operated by Room to Grow LLC, a California limited liability company ("Someday," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your information.

1. Description of Service

Someday is a family-focused wishlist service designed to help parents and children manage desires through photos and structured reflection. The Service allows users to:

• Create and manage wishlists for children
• Photograph items and track wishes over time
• Share wishlists with family members and caregivers
• Track purchased items in a "Trophy Room"
• Use optional AI-powered product identification
• View price comparisons from third-party retailers

2. Eligibility and Account Registration

2.1 Age and Eligibility

To use the Service, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Provide accurate, complete, and current registration information
• Maintain only one account per person
• Not have been previously suspended or removed from the Service

The Service is designed for parents and guardians to manage wishlists on behalf of their children. Children should not create accounts or use the Service independently.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use at support@getsomeday.app

We reserve the right to refuse service, terminate accounts, or restrict access at our sole discretion for any reason, including suspected violations of these Terms.

2.3 Account Deletion

You may delete your account at any time through the app by navigating to Settings → Delete Account. Account deletion will permanently remove your account and all associated data, including child profiles, wish items, and photos. See our Privacy Policy for data retention details.

3. Electronic Communications

By creating an account, you consent to receive electronic communications from us, including:

• Service-related emails (account verification, security alerts, updates)
• In-app notifications
• Push notifications (if enabled on your device)

You may opt out of non-essential communications through your device settings or by contacting us.

4. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

4.1 General Prohibitions

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Provide false or misleading information
• Impersonate any person or entity, or misrepresent your affiliation

4.2 Content Prohibitions

• Upload content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload content you do not have the right to share, including copyrighted material
• Share inappropriate, explicit, or illegal content in wish item photos or descriptions
• Upload sensitive personal information (Social Security numbers, financial account numbers, etc.) to AI features

4.3 Technical Prohibitions

• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or other accounts
• Use any robot, spider, scraper, or other automated means to access the Service
• Circumvent, disable, or otherwise interfere with security features
• Probe, scan, or test the vulnerability of the Service without authorization
• Impose an unreasonable load on our infrastructure

5. Content Moderation and Enforcement

We reserve the right, but are not obligated, to:

• Monitor, review, or remove any user content at our sole discretion
• Restrict or disable sharing features for any user or content
• Suspend or terminate accounts that violate these Terms
• Cooperate with law enforcement authorities when required by law or to protect the safety of users
• Take any action we deem necessary to protect the integrity of the Service

6. User Content

6.1 Your Ownership

You retain ownership of the content you upload to Someday, including photos, wish descriptions, and child profile information. We do not claim ownership of your content.

6.2 License Grant

By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, host, and back up your content
• Display your content to you and users you authorize (such as family members)
• Process, format, and resize your content for technical purposes (e.g., creating thumbnails)
• Use your content with AI features when you explicitly enable them

This license exists solely to operate and improve the Service and terminates when you delete your content or account.

6.3 Content Responsibility

You are solely responsible for all content you upload, including ensuring you have the right to share any photos and that content does not violate any laws or third-party rights.

6.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation or compensation to you.

7. Copyright and Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, features, logos, and content (excluding user-generated content), is owned by Someday and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7.2 Copyright Complaints

If you believe your copyrighted work has been infringed on the Service, please send a notice to support@getsomeday.app containing:

• A description of the copyrighted work you claim has been infringed
• The location of the allegedly infringing material on the Service
• Your contact information (name, address, email, phone number)
• A statement that you have a good faith belief the use is not authorized
• A statement, under penalty of perjury, that your notice is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

We may terminate accounts of users who repeatedly infringe copyrights.

8. Family Sharing Features

Someday allows you to invite family members and caregivers to view and collaborate on wishlists.

8.1 Family Owner Responsibilities

• The family owner is responsible for inviting and managing family members
• Only the family owner can remove members, regenerate invite codes, or delete the family group
• The family owner should only invite individuals they trust with access to child profiles and wishlists

8.2 Shared Member Access

• Invited members can view child profiles and wish items shared by the owner
• Invited members can mark items as purchased or update purchase status
• Invited members can add new wish items for shared children

8.3 Disputes

Someday is not responsible for disputes between family members regarding shared content, wishlist management, or purchase decisions. Family members should resolve such disputes among themselves.

9. Third-Party Services

The Service integrates with third-party services to provide its features:

• Firebase (Google): Authentication, database, cloud storage (Terms)
• Google Gemini: AI product identification (Terms)
• Google Places: Store finder and location services (Terms)
• Apple Services: Sign in with Apple authentication
• Sentry: Error tracking and monitoring (Terms)
• Retailer API Services: Price comparison data from Amazon, Target, Walmart via third-party proxies

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or operation of third-party services, and service outages or changes by third parties may affect Service functionality.

10. AI Features

Someday offers optional AI-powered product identification using Google Gemini.

10.1 How AI Works

• AI features are optional—you can use the Service fully without them
• When you use AI identification, your item photo is sent to Google's AI services
• Photos are processed in real-time and not stored by the AI service

10.2 AI Limitations

• AI-generated product names, descriptions, and price estimates may be inaccurate or incomplete
• You must verify all AI-generated information before making purchase decisions
• Do not upload sensitive personal information, documents, or inappropriate content to AI features

10.3 Changes to AI Features

We may modify, limit, or discontinue AI features at any time without notice.

11. Price and Availability Information

Someday provides price comparison and store availability information from third-party retailers.

• Price and availability data is retrieved from retailer APIs and may not reflect current pricing
• We do not guarantee the accuracy, completeness, or timeliness of pricing information
• Prices and availability may vary by location and are subject to change without notice
• Always verify pricing directly with the retailer before making purchase decisions
• Someday is not affiliated with and does not represent any retailer

12. Service Availability and Changes

We strive to provide a reliable service, but:

• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control
• We may modify, suspend, or discontinue any feature of the Service (including AI features, price comparison, and store finder) at any time without notice
• We are not liable for any modification, suspension, or discontinuation of the Service or any feature

13. Fees and Payments

The Service is currently free to use. We may introduce paid features or subscription plans in the future. If we do, we will present the applicable terms, pricing, and payment conditions before you are charged. Any paid features will be subject to Apple's in-app purchase terms where applicable.

14. Disclaimer of Warranties

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• AI-generated product information will be accurate
• Pricing data or store availability will be current or correct
• The Service will meet your specific requirements

You use the Service at your own risk.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMEDAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM:

• Your use of or inability to use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access to or alteration of your content
• Reliance on AI-generated information or pricing data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Someday and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content uploaded to the Service

17. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:

• Violations of these Terms or our policies
• Conduct that we believe is harmful to other users or the Service
• Extended periods of inactivity
• Requests by law enforcement

You may delete your account at any time through the app by navigating to Settings → Delete Account.

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including Disclaimer, Limitation of Liability, Indemnification, and Dispute Resolution) shall survive.

18. Dispute Resolution and Governing Law

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

18.2 Venue

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in these courts.

18.3 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

18.4 Consumer Rights

Nothing in these Terms affects your statutory consumer rights that cannot be waived or limited by contract under applicable law.

19. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting a notice on the Service
• Sending an email to your registered address
• Updating the "Effective Date" at the top of this page

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

20. General Provisions

20.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Someday regarding the Service.

20.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

20.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

20.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

20.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
